Sharing the road with big rigs and 18-wheelers is a daily part of life. Keeping an eye out for wide turns made by these vehicles can be worrisome if the vehicle’s driver doesn’t take proper precautions. Being careful is a responsibility that has to be shared by all on the road, but what happens when a driver with a larger vehicle fails to properly operate his/her vehicle and collides with you? Will the company that runs these tractor-trailers uphold their obligations and make sure your family is taken care of after a major accident occurs?
In many situations, this may not be the case. This is where personal injury lawsuits come in. Having to deal with repairs and/or hospital bills is a burden that a victim of a car accident should never have to deal with. In early May of 2016, two people found themselves to be victims of such a situation.
Tractor-Trailer Seriously Injures Two People
According to a complaint filed in Jefferson County Texas in early July, a man and a child were driving when a tractor-trailer failed to yield the right of way. The trucker allegedly made an illegal turn from the wrong lane, causing a wreck that severely injured the man and child.
The suit names the driver and his employer as the responsible parties. The employer was named as being liable due to hiring the driver and claiming it carelessly entrusted him with operating the large vehicle. The plaintiffs are requesting a trial by jury to seek an unspecified amount of damages, exemplary damages, pre- and post-judgment interest and court costs.
What the Experts Say
Attorney Richard Fryer talked about what can happen when a driver finds him/herself involved in a trucking accident with an 18-wheeler. ”When cases like these take place, we try to get our clients help and financial compensation. Not only do we go after the driver, we also go after the trucking company because they may also be responsible.”
